The offer on inclusion of the given model law (originally under the name «About preventive maintenance and treatment of a diabetes in the state-participants CIS») in the Long-term plan of creation of model laws and rapprochements of national laws in the Commonwealth of Independent States for the period till 2005 has been brought at session of Constant commission MPA of the CIS on social policy and human rights on April, 23, 2003 and authorized at session of Council IPA of the CIS on June, 16, 2003.
The urgency of development of the given model law is defined by absence in overwhelming majority of the state-participants CIS of the special legislation devoted to questions of protection of the rights of citizens of patients by a diabetes while their number in the CIS is made 3,5 million by person and has the proof tendency to growth. In a lot of the state-participants CIS the decision of the given questions is carried out at a level of the general{common} legislation on health protection of citizens, and also development of national programs on preventive maintenance and treatment of a diabetes.
The head developer of the project of the given model law authorizes working group on development of model laws on questions of public health services.
The text, the prospective project of the model law, is prepared at expert support of the St.-Petersburg diabetic society, has passed preliminary consideration, in parliaments of some the states CIS.
Conceptual positions of the project have passed discussion at international conference holding from June, 6 till June, 8, 2003 in Saint Petersburg « Yesterday, today, tomorrow of diabetes ». It has passed at participation of the President and members of Board of the European Region of The International Diabetes Federation; heads and representatives of Diabetic Associations of Azerbaijan, Belarus , Georgia , Kazakhstan , Kyrgystan , Ukraine , Russian Federation , Latvia , Moldova , Finland ; directors of profile scientific institutes and the centers of these countries.
By results of the lead discussions the subject and structure, and also the name of the model law have undergone changes.
The basic purposes of a legal regulation of the suggested project are:
- An establishment of fundamental laws of the citizens sick of a diabetes in the correspondence with the obligation of the states on their realization;
- Definition of a state policy in the field of medical &social protection of the specified category of citizens, formation of system state diabetes care as bases of realization of the rights of citizens.
The project of the model law contains the indication on concrete actions, privileges and services, carrying out and which granting is capable to provide maintenance of minimally necessary standard of living of the citizens sick of diabetes.
By present time of the remark and the offer under the project of the model law were received from National Assembly of Byelorussia, the Senate of Parliament of Republic Kazakhstan, Parliament of Republic Moldova, Majlisi of Republics Tadjikistan.
